Terms

Little Seed Shed, Morden, Manitoba

These terms apply when you buy from this site. Placing an order means you accept them. If something here is unclear, ask before you order.

Ordering

You must be old enough to enter a contract where you live. Orders are accepted at my discretion, and I may refuse or cancel one, including after it has been placed. If I cancel an order you have paid for, you are refunded in full.

Prices, and mistakes in them

Prices are in Canadian dollars. No tax is added, because I am below the threshold at which I would have to charge it.

Prices and stock can change without notice. If a price, description or availability on this site turns out to be wrong, I may correct it and cancel any order placed against the mistake, even after it was confirmed. You are refunded in full. I will not hold you to an error, and I ask that you do not hold me to one either.

Paying

By Interac e-transfer. Nothing is posted or handed over before the payment has cleared.

An e-transfer order stays open for a couple of days. The seed in it is set aside for you while it waits, and goes back on the shelf if the transfer does not arrive in time.

Stock

The counts shown are real. Seed in an unpaid order is set aside until it is paid for or the order lapses, so the same packet cannot be ordered twice. If a count is ever wrong and two orders are paid for the last packet, the second one is refunded in full and I will email you the same day.

Postage and collection

Seed is posted anywhere in Canada for a flat $6.00, and free on orders over $100.00. Nothing is posted outside Canada. Plants and tubers are never posted at all; they are collected in Morden, and there is a tick box at checkout for collecting anything else too, which removes the postage.

Ordinary postage carries no tracking. That is why it is inexpensive. It also means that if a packet does not arrive, neither of us can establish what became of it, and I cannot replace or refund an untracked order that fails to turn up. Choosing it is your decision and the risk sits with you.

No delivery date is promised. Orders are packed by hand, and Canada Post is not mine to hurry.

Whether it grows

There is no germination guarantee, and no seed seller can honestly give one. Once a packet leaves here, how it is stored, how deep it is sown, how it is watered, what the weather does and what the slugs decide are all outside my control, and any one of them will stop a seed coming up.

What I can tell you is the year the seed was harvested, which is on every listing, so you know how fresh it is.

If a whole packet does nothing and you have grown things before, tell me anyway. It may be my seed rather than your garden, and I would rather know. Where it looks like my end, I will put it right.

Returns and refunds

Seed cannot be returned once it has left, and anything living is checked when you collect it. If I send the wrong item or it arrives damaged, that is mine to fix.

The full detail, including how a refund is paid and how long it takes, is on the refunds and returns page.

Growing information on this site

Sowing depths, spacings, temperatures and timings come from named references, and those references are recorded. They remain guidance. A growing season is not a laboratory and your garden is not mine, so treat them as a starting point rather than a promise.

What I am not responsible for

This is a small garden business. My responsibility for any order is limited to what you paid for it. I am not responsible for a crop that fails, a season that is lost, or any indirect loss that follows from something bought here.

Nothing in these terms removes rights you have under Canadian consumer protection law, which cannot be signed away and which stand whatever this page says.

Using this site

Do not use this site to break the law, and do not attempt to interfere with it, overload it, or gain access to parts of it that are not public.

If part of this does not hold

If any part of these terms is found to be unenforceable, the rest still applies.

Which law applies

These terms are governed by the laws of the Province of Manitoba and the laws of Canada that apply in it.

Changes

These terms may change. The version that applies to your order is the one on this page on the day you ordered.

Contact

Anything to do with an order or with these terms goes through the contact form.
